All custom phone case designs created by customers using the Xcase.me platform, including those generated with the assistance of AIGC technology, are considered the intellectual property of the individual customer. This includes, but is not limited to, personalized designs, graphics, text, and any other custom elements added by the customer.

2. Platform Role and Liability

Xcase.me serves as a facilitator for the creation and printing of custom phone case designs. As such, the platform does not claim ownership of any custom designs created by customers. The platform's role is limited to providing the tools and technology necessary for customers to create their personalized phone cases.

3. Intellectual Property Rights

By using the Xcase.me platform, customers acknowledge and agree that:

1) They retain full ownership and intellectual property rights over their custom designs.
2) Xcase.me does not claim any rights to reproduce, distribute, or use the custom designs beyond the purpose of creating the physical phone cases as ordered by the customer.

4. Responsibility for Content

Customers are solely responsible for ensuring that their custom designs do not infringe upon the intellectual property rights of others. This includes, but is not limited to, the use of copyrighted images, trademarks, or other protected content. Xcase.me disclaims any liability for disputes arising from the use of third-party intellectual property in customer designs.

5. Compliance with Local Laws

Customers must ensure that their custom designs comply with all applicable laws and regulations in their respective countries. Xcase.me operates in accordance with the intellectual property laws and regulations of mainstream Western countries, including but not limited to the United States, the United Kingdom, Canada, and member states of the European Union.

6. Social Media Publication

Customers may choose to share and publish their custom designs on various social media platforms, including Facebook, Instagram, TikTok, YouTube, and Twitter. Customers acknowledge that:

1) Such actions are undertaken independently by the customer and do not involve or implicate Xcase.me.

2) Xcase.me does not control or endorse the content shared by customers on these platforms.

3) Customers are responsible for ensuring that their shared content complies with the terms of service and community guidelines of the respective social media platforms.

7. Indemnification

Customers agree to indemnify and hold harmless Xcase.me, its affiliates, and employees from any claims, damages, or legal actions arising from the infringement of intellectual property rights or violations of applicable laws related to their custom designs.

8. Limitations of Liability

To the fullest extent permitted by law, Xcase.me shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the use of the platform, including but not limited to damages for loss of profits, goodwill, or other intangible losses resulting from:

1) The use or inability to use the platform.
2) Unauthorized access to or alteration of customer designs.
3) Any other matter relating to the platform.

9. Amendments

Xcase.me reserves the right to amend this disclaimer at any time. Customers will be notified of any significant changes to the policies outlined herein.

10. Governing Law

This disclaimer shall be governed by and construed in accordance with the laws of the jurisdiction in which Xcase.me operates. Any legal disputes arising from this disclaimer shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

By creating and ordering custom phone cases through Xcase.me, customers acknowledge that they have read, understood, and agreed to this legal disclaimer.
